Reports indicate that Kasaris instructed Pasela to deceive Viola by posing as a graduate student and recording confidential conversations. Even more disturbingly, she was allegedly directed to contribute funds toward Viola’s legal fees as part of an investigative ploy.
Pasela, privy to the inner workings of the prosecution, later grew uneasy with the legal irregularities she witnessed. She became aware that exculpatory evidence—evidence that could have aided Viola’s defense—was being intentionally withheld by prosecutors. However, in response to this request, Scott M. Tuma, Law Director and Chief Prosecutor for the City of Parma, stated that he had reviewed the available files, including the County Medical Examiner’s report and subsequent toxicology reports. He agreed with the previous decisions made by Parma Safety Director Brian Coury and former Law Director Tim Dobeck not to reopen the investigation. Tuma did indicate that he would be open to reviewing any new evidence that may emerge.
